Data controller
The Data controller is TEXA S.p.A. with registered office in via 1 Maggio 9, 31050 Monastier di Treviso (Italy), VAT No. 02413550266, (hereinafter “TEXA” or the “Controller”). Category of processed data and nature of provision
The TEXA website www.texa.it, as well as www.texa.com, www.texadeutschland.com, www.texafrance.fr, www.texaiberica.com, www.texa.co.uk, www.texapoland.pl, www.texa.ru, www.texausa.com, www.texabrasil.com.br, www.texalatam.com (hereinafter jointly referred to as “Website”) and the online accounts such as myTEXA, (hereinafter “Accounts”) are owned and entirely managed by TEXA. The Website and the Accounts are intended for professional users (B2B). However, following consultation or voluntary registration therein, data related to identified or identifiable natural persons may be processed: personal data are collected and processed for purposes strictly related to the use of the Website and Accounts, to the registration processes envisaged therein, to the use of the services reserved to registered Users and offered through the Website and the Accounts.
Navigation data
The computer systems and software procedures used to operate the Website acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with identified data subjects, but due to its very nature could, through processing and association with data held by third parties, allow the identification of the Users.
This category of data includes:
- the IP addresses or domain names of the computers used by the Users who connect to the Website;
- the addresses in the URI (Uniform Resource Identifier) notation of the requested resources;
- the time of the request;
- the method used in submitting the request to the server;
- the size of the file obtained in response;
- the numerical code indicating the response status given by the server (successful, error, etc.) and other parameters relating to the operating system and the IT environment of the Data Subject.
These data are used for the sole purpose of obtaining anonymous statistical information on the use of the Website and to check its correct operation.

Except for this eventuality, the data are kept within the timeframe defined by the regulations of reference for the time strictly necessary to provide the User with the requested service and to guarantee the transmission of the communication.
Data voluntarily provided by the User
Aside from what is specified for the navigation data that are necessary to implement the IT and digital protocols, the provision of personal data by Users is free and optional, although useful for the provision of certain services: in these cases, therefore, failure to provide the data could compromise or make it impossible to provide the service. Personal data provided by Users who voluntarily interact with the Website, provided for obtaining certain services (e.g. registration to the web portals mytexa.com, care.texa.com, servicecode.net, etruck-workshop.texa.com, etruckfleet.texa.com, customercare.texa.com; elearning.texa.com, registration to events, subscription to the newsletter, requests for information, sending of e-mails), are used only to perform the service requested and are communicated to third parties only if this is strictly necessary for the performance of the service.
The personal data that the User may voluntarily provide are the following:
- identification data: name and surname, tax code, VAT No., address;
- contact data: telephone numbers and e-mail address;
- contract data: customer number, contract number, serial number of the tool, TEXA ID;
- online account data: data required by TEXA web portals: e-mail and password.
The provision of data for receiving the newsletter, which may consist in informative/promotional communications on products and services offered by the Controller, opinion and satisfaction surveys and/or invitations to events organised or attended by the Controller (so-called “direct marketing” purposes), is optional and the User is free to give his/her consent for such processing.
The consent may be revoked at any time by clicking on the Unsubscribe link at the bottom of each e-mail or by sending an e-mail to privacy@texa.com with “newsletter cancellation” as the e-mail subject. In the various Website forms, depending on the case, the mandatory or optional nature of the provision of personal data will be highlighted by adding a specific character (*) to any information of a mandatory nature.

Processing purposes and legal basis
The Users’ information and personal data collected by the Website, including the data voluntarily provided, are processed for the following purposes:
- to register to the web portals;
- to allow the use of the services reserved for registered Users accessible from the web portals listed in the previous point, aimed at a better management of the relationship with the User;
- to register to the events advertised in the Website and/or in the reserved area accessible through the web portals (seminars, webinars) and for the consequent management of the related organisational and administrative obligations;
- to send, via e-mail, answers regarding our products and services;
- to anonymously process statistics (e.g. to evaluate the number of accesses);
- to send the newsletter via e-mail;
- subject to the explicit consent by the User, to carry out direct marketing activities, i.e. sending the newsletter via e-mail, as well as informative and/or promotional communications, opinion and satisfaction surveys and/or invitations to events organised or attended by the Controller;
- to comply with legal obligations and provisions of the competent Authorities.
Data retention period
The Users’ personal data collected by this Website or voluntarily provided by Users themselves will be retained only for the purpose of guaranteeing the correct performance of the services requested and/or offered through the web portals or for the achievement of any other legitimate connected purpose (for example, where they are relevant to a defence against claims made against TEXA or in the presence of a legitimate interest) and for the duration necessary for the same purpose. Therefore, if the personal data are processed for two different purposes, the data will be retained until the end of the purpose with the longest term; however, personal data will no longer be processed for purposes whose retention period has ceased.
If the account is cancelled or disabled, the User’s data will be stored for administrative purposes for a period not exceeding one semester, without prejudice to any specific legal obligations regarding the keeping of accounting documentation.
The data processed for direct marketing purposes will be processed for a period proportionate to these purposes and in any case as long as the User remains subscribed to the newsletter or does not revoke his/her consent.
Data disclosure to third parties - recipients of the data
Without prejudice to communications made in compliance with legal obligations, the personal data collected may be communicated, based on the purposes described above, to the following subjects:
- companies of the TEXA group (subsidiaries and associated companies pursuant to the legal provisions in force) for processing operations with the same purposes described in this policy;
- subjects belonging to the TEXA sales, distribution, assistance and logistics network;
- TEXA employees and/or collaborators who received adequate operating instructions and were expressly authorised to the processing;
- third parties (companies or professionals) that will perform technical, organisational and operational tasks on behalf of TEXA and in turn will be appointed Processors or operate autonomously as separate Controllers.
The updated list of Processors is kept at the Controller’s premises. The personal data will not be disclosed and, where necessary for providing the requested services, they may be transferred to entities located in countries outside the EU, if the European Commission has acknowledged such countries to have an adequate level of data protection or on the basis of adequate guarantees (such as standard contract terms or binding company rules for groups).
Rights of the data subjects
With regard to the provided Data, the GDPR (articles 12 and 15-22) grants that every Data Subject can exercise the right to access the data concerning him or her and the information about processing; to rectify or integrate the data if inaccurate or incomplete. Moreover, where the conditions set forth by the regulation are met, the Data Subject can exercise the right to erasure of the Data; to restriction of processing; to Data portability intended as the right to obtain the data by the Data Controller in a structured, commonly used and machine-readable format to transmit those data to another controller without hindrance; to object to processing; not to be subject to a decision based solely on automated processing. If the Personal Data processing is based on consent, the Data Subjects have the right to withdraw their consent, without prejudice to the lawfulness of processing performed before the withdrawal. Furthermore, if you believe your rights have been harmed, you can lodge a complaint to the Guarantor for the Protection of Personal Data.
